Is it allowed to change the state flag even though our server is out of the country?

Only if its near the actual location.
PS. I don't recommend posting in the resolved bugs forum, as it really implies that you need no answer to your own question.

Hmm..oke but then this server is from Romania...but on tracker is flag from russia and second server have flag spain..but they are from romania and they every time change flags..what abaut him?

It's not that far away.
Use the report abuse feature for any servers abusing the feature.
