You need to use the appropriate reporting system with the proper evidence otherwise there has not been anything proven to be against the TOS.

For example, "Hey that is my avatar and you used it without permission!" *User banned*
Obviously you can see the flaw in this that any person can make any accusation and have it taken for granted. Unfortunately, we cannot be exploited so easily.
